Dual Occupancy homes in Brisbane: two dwellings on the one title, that can be rented out separately, but not strata titled.

A common question I am often asked is, “Can you build a Dual Occupancy in Brisbane?” Firstly, to clarify in other classification terms:

Duplex: two dwellings on the one title, which can be strata titled (to allow separate titles) and sold off separately.

Granny Flat: a secondary dwelling that is a maximum of 80sqm in size, and cannot be rented to someone who doesn’t form part of your household.

Please note that the Brisbane City Council use the term dual occupancy to refer to a Duplex. So in some instances people referring to dual occupancy Brisbane may actually be referring to a Duplex.

The short and most direct answer to building Dual Occupancy homes in Brisbane, is no. Brisbane City Council don’t allow the dual occupancy concept (or Auxiliary) as defined above. The council allow duplexes where they meet the specific lot requirements, and also Granny Flats. A Granny Flat however shouldn’t be rented out to a person who doesn’t form part of your household, and if you are renting it out to a separate party you should be ready to receive a ‘Show Cause Notice’ from Council. There are instances of dual occupancy homes in Brisbane in which people are renting out dual occupancy properties to other parties, however we don’t recommend this.

So, a dual occupancy won’t work within the Brisbane City Council Area, however, they work within the Ipswich City Council, Logan City Council, and also Pine Rivers/Moreton Shire Council Areas. With these three Councils (please note each Council differs in the specific rules and regulations) allowing dual occupancy, there is a great range of growth locations where a dual occupancy investment can work extremely well.

So Dual Occupancy in Brisbane isn’t a possibility, however, under 20km out from the CBD in Logan a dual occupancy investment works very well!
