Dual occupancy designs have become a much sought after property option in the Logan Area (South of Brisbane) for both investors and owner occupiers. As I’ve mentioned previously, the rules and regulations for dual dwellings vary across each council area. There are a number of rules around Logan dual occupancy designs which I will go into below. Please be aware that the Logan City Council refer to these as Dual Occupancy (Auxiliary Unit).

What is a Dual Occupancy (Auxiliary Unit)?

According to the Logan City Council, a Dual Occupancy design (Auxiliary Unit) is where both dwellings are owned by the same person on one land title and the Auxiliary Unit:

  1. It has a maximum of two bedrooms;
  2. It has no more than one kitchen;
  3. There is no more than one living space;
  4. Together with the dwelling house or primary dwelling, has only one vehicle crossover (driveway);
  5. It has the maximum size of 70m² if it is in the residential zone category and on a lot less than 1000m², or 100m² otherwise.

 

What is the assessment level for a Dual Occupancy Design (Auxiliary Unit)?

The approval process for a dual occupancy property can be a relatively easy and straightforward process for those that have dealt with them before.

Dual occupancy designs (Auxiliary Units) are easy to develop under the planning scheme as they often do not require Council approval and do not have a minimum lot size.

If a dual occupancy complies with the density requirements, and the self-assessable criteria, in most instances it will be self-assessable. This means that it doesn’t have to go through a full council approval process.
